Domestic business associations appealed to the head of state with a request to consider business proposals to the draft law on the Financial Intelligence Service.
“Law enforcement agencies do not enjoy the trust of society and business. Therefore, the recruitment of personnel to the SFR should be carried out with a quota of no more than 10% of employees from the former employees of the Ministry of Internal Affairs, DFS, SBU, prosecutors regardless of the period and duration of their work in the said bodies, “- said in a letter to the President of Ukraine P. Poroshenko, Prime Minister of Ukraine V.Groysman and Speaker of the Verkhovna Rada of Ukraine A.Parubiya.
Business associations are asked to leave the SFR in the management of the Ministry of Finance, in accordance with the goals set up in the creation of the Service and in accordance with the analysis of international experience – this is logical and emphasize that the SFR can not be in the management of the Ministry of Internal Affairs. And the head of the SFR should be politically independent and independent in decision-making. The only way to ensure this is to elect it at an open, independent competition. It is also proposed to limit the number of employees of the new department at the legislative level – no more than 3000 people.
They also mentioned pressure on business – that is why Article 191 parts 4 and 5 of the Criminal Code of Ukraine, as widely used by the Ministry of Internal Affairs, the DFS, the SBU, the prosecutor’s office for unlawful pressure on business, are to be classified as exclusive subordinate to the SFR.
In order to ensure the effective and efficient work of detectives in the SFR, and to prevent the flow of operational information, it is proposed to provide the SFR and the opportunity to independently carry out the entire spectrum of operational and technical measures with the removal of information from communication channels inclusive
Business associations are asking the authorities to take as a basis the draft, prepared by the Cabinet of Ministers, and to finalize it as soon as possible in accordance with the proposals, which were signed by 50 business associations of the country.
